Terms and Conditions
Take a moment to read through these terms and conditions before you start using the Service.
Interpretation and Definitions
Some words in these conditions are capitalized, and we've defined what they mean below. Whether they show up in singular or plural form, the definition stays the same. When we use these Terms and Conditions: • Affiliate refers to any entity that controls, is controlled by, or shares common control with a party. • Country means Washington, United States • Company (also called "the Company", "We", "Us" or "Our") is Opengarden. • Device is anything that can access the Service—your computer, phone, tablet, whatever. • Service is the Website. • Terms and Conditions (sometimes just "Terms") are what you're reading now. They're the whole agreement between you and the Company about using the Service. • Third-party Social Media Service covers services or content from someone else that shows up on or comes through the Service. • Website is Opengarden. • You means whoever's accessing or using the Service, or the company or legal entity on whose behalf they're doing it.
Acknowledgment
These Terms and Conditions control how the Service gets used and form the agreement between you and the Company. They spell out what rights and responsibilities everyone has. Getting access to and using the Service depends on you accepting these Terms and Conditions and following them. They apply to everyone who visits, uses, or accesses the Service in any way. Once you access or use the Service, you're agreeing to be bound by these Terms and Conditions. If any part doesn't work for you, you can't use the Service. You're confirming that you're at least 18 years old. Anyone under 18 isn't allowed to use the Service.
Links to Other Websites
The Service might have links to third-party websites or services that the Company doesn't own or run. The Company doesn't control these other sites and isn't responsible for what's on them, their privacy policies, or how they operate. You understand and accept that the Company isn't liable for any damage or loss that happens because of content, products, or services you find through those links or websites.
Termination
We can shut down or cut off your access right away, without warning or any liability, for pretty much any reason—especially if you're not following these Terms and Conditions. Once that happens, your right to use the Service is gone.
Limitation of Liability
No matter what damages you end up with, the Company and its suppliers' total liability under these Terms is capped at what you actually paid for the Service. If you haven't paid anything, that cap is 100 USD. Under applicable law, the Company and its suppliers won't be responsible for special, incidental, indirect, or consequential damages. That covers loss of profits, data, business interruption, personal injury, privacy violations, or problems with third-party software and hardware used with the Service—even if the Company was warned this could happen and even if the remedy doesn't work the way it's supposed to.
"AS IS" and "AS AVAILABLE" Disclaimer
The Service comes as-is and as-available, with all its faults and problems, and no warranties at all. To the fullest extent allowed by law, the Company and its Affiliates, licensors, and service providers say no to all warranties—express, implied, legal, or otherwise—about the Service and everything in it, including implied warranties about how it works for sale and for a particular purpose. To be clear, neither the Company nor any provider makes any claim or guarantee, express or implied, that the Service will work or be available, that the information and content are right, that the Service will run without stopping or errors, that anything through the Service is accurate or up to date, or that the servers and emails are free of viruses, trojans, worms, malware, or anything else harmful.
Governing Law & Disputes Resolution
These Terms and your use of the Service are governed by the laws of the Country, not including its conflict of law rules. Where you live might also have local, state, national, or international laws that apply. If you run into a problem or disagreement with the Service, you agree to try sorting it out informally first by reaching out to the Company.
Compliance & Regulations
For European Union (EU) Users: If you're an EU consumer, the mandatory protections under your country's laws still apply to you. United States Legal Compliance: You confirm that you're not in a country under U.S. government embargo or labeled as "terrorist supporting," and you're not on any U.S. government list of prohibited or restricted parties.
Severability and Waiver
If any part of these Terms can't be enforced or isn't valid, that part gets changed or interpreted to work as much as possible under the law, and everything else keeps going. If either party doesn't use a right or enforce an obligation under these Terms, that doesn't stop them from using or enforcing it later. And skipping one breach doesn't mean they're overlooking the next one.
Changes to These Terms and Conditions
These Terms and Conditions might be in another language, but if there's ever a dispute, the original English version wins. We can change or replace these Terms whenever we want. If it's a big change, we'll do our best to give you at least 30 days' notice before the new terms kick in. Keep using the Service after that date and you're agreeing to the updated version. These terms and conditions become effective on insert current date
